NEW NEVADA LANDLORD/TENANT LAWS

AB121 (effective 10/01/2025), 118A.200. 
1. Landlord is REQUIRED to provide Tenant with at least one (1) method of paying rent, other fees, and charges that does NOT require Tenant to:  a) pay any fees or charges; and  b) provide Tenant banking information (bank information on checks paid by a Tenant is ok).
2a. If Teanants use an Internet Website or Online Portal to pay rent, etc., then Landlord can NOT charge Tenant any amount past the fee charged by the Website or Portal operator.
2b. Any Internet Website or Online Portal fee MUST be separately identified in the Lease Agreement.
​3. If Landlord violates Tenant rights under this new law, then Landlord shall pay Tenant:  a) any damages;  b) any equitable relief;  c) preparation, filing, and Court fee costs, and reasonable Attorney fees; AND  d) statutory damages of $250 for each violation.
4. Landlord MUST provide a prospective (approved by Landlord) Tenant, upon written request, a copy of the Lease Agreement, prior to execution.
5. Landlord that collects a screening fee (application fee, credit report fee, background check fee) is REQUIRED to REFUND that fee back to that Prospective Tenant (PTen) if:  a) Landlord rents property to a DIFFERENT prospective Tenant; AND  b) Landlord does NOT perform the screening process.  Examples of NO REFUND and REFUND:

-- NO REFUND-1: PTen-1 Pays, and PASSES screening process, AND Landlord rents property to PTen-1.
-- NO REFUND-2: PTen-1 Pays, and FAILS screening process, AND Landlord rents property to PTen-2.
-- REFUND-1: PTen-1 Pays, and PASSES screening process, AND Landlord rents property to PTen-2.
-- REFUND-2: PTen-1 Pays, but NOT screened, AND Landlord rents property to PTen-2.

6. Landlord is NOT allowed to charge and collect a screening fee for any MINOR (age 17 or younger).
7. Lease Agreement MUST have a monthly single figure (for maximum total amount of periodic rent) {that includes monthly base rent, plus (+) any monthly mandatory fees, plus (+) any monthly flat utlity or monthly flat convenience service fees}.
-- Mandatory fees: Association, Parking, Pool, Gate, Maintenance, Insurance, Pest Control, and any other related fees.
-- Utilities: Electric, Natural Gas, Water, Sewer and Trash.
-- Convenience Services: Phone, Satellite/Cable (Internet, TV), Alarm Service, Security Camera Service.
8. Landlord is NOT allowed to charge Tenant any periodic rent amount  that EXCEEDS the single figure (for maximum total amount of periodic rent), indicate in the Lease Agreement.
9. Landlord CAN charge Tenant a separate monthly actual bill amount (NOT included as a flat utility fee in the single figure {for maximum total amount of periodic rent}) for electric, natural gas, and water ONLY if:  a) utility company is unable or unwilling to contract directly with Tenant;  b) Landlord MUST put an asterisk (*) or some type of a reference symbol next to the RIGHT of the single figure (for maximum total amount of periodic rent), BUT that reference symbol MUST be at least 1/2 or equal to the font size of the single figure 
(for maximum total amount of periodic rent);  c) puts information on the same page as the single figure (for maximum total amount of periodic rent), that informs or states to the Tenant that this utlity company (name) and phone number is unable or unwilling to contract directly with the Tenant, AND Tenant will be charged monthly for the actual utility bill (separate from the single figure {maximum total amount of periodic rent).

AB308 (effective 07/01/2021)
1a. NRS 118.101. Disabled Tenants can, upon written request: a) make Tenant PAID disability modification to property; and b) Landlord can make reasonable accomodations in rules, policies, practices or services. 
1b. Landlord can REQUIRE disabled Tenant, upon termination of Lease, restore property back to its original condition before disability modification was granted by Landlord. 
1c. Landlord can ONLY increase the disabled Tenant's Security Deposit amount, after disabled Tenant request, if the additional deposit amount (past normal non-disabled security deposit amount) does NOT exceed the actual cost of restoration (obtain written restoration estimate), is deposited in an intererest-bearing account, and any interest  erned MUST be paid back to the disabled Tenant making request.
2. NRS 118A.210. Landlord can NOT charge a monthly late fee, until at least three (3) calendar days AFTER the rent due date.
​3a. NRS 118A.300. Landlord is REQUIRED to serve a monthly Tenant with a sixty (60) calendar day written notice to increase rent.
​​3b. NRS 118A.300. Landlord is REQUIRED to serve a daily, weekly (less than 1 month) Tenant with a thirty (30) calendar day written notice to increase rent.

SB151 (effective 07/01/2019)
The information indicated below is a recap, overview and only applies to monthly rental properties.
1. 5-Day Pay Rent is now a 7-Day Pay Rent notice.  Tenant has until the close of business day, on the seventh (7th) judicial day, to pay rent to Landlord.  Notice days does NOT count for the date of service, holidays, nor weekends.
2. The notice to Tenant must: a) identify the Court having jurisdiction; and b) advise Tenant of rights.
3. A Landlord can NOT refuse to accept rent from a Tenant, after a rent notice with a specific amount indicated has been served, if Tenant has not paid collection fees, attorney fees or other costs other than rent, a reasonable charge for late payments of rent or dishonored checks, or a security.
4. NRS 40.255.  a) This section pertains to properties obtained by transfer or sale, (NOT foreclosure);  b) the existing lease remains in effect until the end of its term; and  c) new owner shall preserve and maintain the Tenant's deposits from the previous owner or landlord, (NRS 118A.242).

5. NRS 40.255.  The new owner MUST provide a notice to the Tenant or Subtenant, within thirty (30) days after the date of the transfer or sale, (NOT foreclosure).

NRS 40.280.  Notices MUST be served by the sheriff, a constable, a licensed process server, or the agent of an attorney licensed in Nevada.  No longer can owners, owner's friends, owner's family, real estate agents, property managers, or brokers serve notices.
7. NRS 118A.210.  a) Late fee can NOT exceed five (5%) percent of the monthly rent (ex: $1,000 monthly rent x .05 percent max late fee = $50 late fee monthly); and  b) the late fee previously imposed can NOT be increased once a lease is executed.
8. NRS 118A.460.  a) During the 5-Day period following the eviction or lockout of a Tenant, Landlord MUST allow former Tenant reasonable access to retrieve essential personal effects, (including, without limitation, medication, baby formula, basic clothing and personal care items.), and  b) Landlord could be fined up to $2,500 for Tenant damages.
