Las Vegas Landlord wants you to be prepared in the event that your Tenant files bankruptcy. You may have already served a notice and filed an eviction with the Court, but now you have a problem because your Tenant has filed bankruptcy and is protected from an eviction.
Now, this is not the end of the world. LVL can support the Justice Court Eviction and your Attorney with the Bankruptcy Court lift of the Automatic Stay. Then continue with the Justice Court Eviction case once the Automatic Stay is lifted.

If Tenant Files Bankruptcy
If a Tenant files bankruptcy, that is OK, but you must protect yourself if you are indicated as a Creditor on the Tenant's bankruptcy. You should at least do the following:
NO Eviction with Justice Court
1. Normally if you are listed as a Creditor under the Tenant's bankruptcy, you will receive a letter from the Tenant's Bankruptcy Attorney. Take that letter to your Attorney.
2. Your Attorney will advise you on what action should be taken to protect yourself.
Eviction with Justice Court
1. Normally if you are listed as a Creditor under the Tenant's bankruptcy, you will receive a letter from the Tenant's Bankruptcy Attorney. Take that letter to your Attorney.
2. If you have an Eviction before the Justice Court, that Eviction will be suspended, until the Bankruptcy Court lifts the Automatic Stay.
3. Once your Attorney has lifted the Automatic Stay with the Bankruptcy Court, you can continue with your Justice Court Eviction.
